Copyright & DMCA Policy

Last updated

Coaches publish programs, courses, videos and writing on CoachVana, and that work deserves protection. We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. 512), and we close the accounts of repeat infringers.

Reporting an infringement

If you believe something on CoachVana infringes a copyright you own or are authorized to act for, send our designated agent a written notice that includes:

  1. Your physical or electronic signature.
  2. The copyrighted work you say is infringed, or a list if there are several.
  3. The material you say is infringing, and enough to let us find it, such as its link, the coach's page, or the group and post.
  4. Your name, postal address, phone number and email.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

We remove or disable the material, tell the person who posted it, and send them a copy of your notice, which includes your contact details. A notice missing these elements may not be acted on.

If your content was removed

If you believe material you posted was removed by mistake or because it was misidentified, you can send our designated agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. The material that was removed and where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district where we may be found), and that you will accept service of process from the person who sent the notice or their agent.

We send your counter-notice to the person who reported the material. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we restore the material within 10 to 14 business days of receiving your counter-notice.

Repeat infringers

We close, in appropriate circumstances, the account of anyone who is the subject of repeated valid infringement notices, and we may limit an account sooner where the infringement is clear.

False notices

Under 17 U.S.C. 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages. If you are not sure whether something infringes your rights, ask a lawyer before you send a notice.

Trademarks and other rights

For a trademark, a right of publicity (someone using your photo or name), or another concern that is not about copyright, email support@coachvana.com and say what is wrong and where. Our Acceptable Use & Community Guidelines cover sharing someone's photos or words without permission.
